- “Client”: Any person or entity that engages WPDriven for services.
3. Website Use By using our Website, you agree to do so for lawful purposes only and in a manner that does not harm or disrupt the Website or its services. Unauthorized use, including attempting to access our systems, is strictly prohibited.
4. Services, Pricing, and Payments
- Project Initiation: All services require a formal agreement. Prices for services are subject to change, and payment for a project must be made as per the agreed-upon invoice before work commences.
- Payment Terms: For projects with partial payments, the final balance is due upon project completion and before the website or app goes live. WPDriven reserves the right to suspend or terminate services if the final payment is not received. All payments are non-refundable once services have been rendered.
- Project Inactivity: To ensure momentum, client communication is essential. If a client ceases communication for 25 consecutive days, the project will be archived. To reactivate an archived project, a penalty equal to one month of the standard maintenance fee will be charged.
- Revision Policy: We offer revisions to ensure your satisfaction. However, if a project exceeds 100 revisions, it will be considered complete. At this point, the project will be prepared for final launch, or a separate monthly maintenance package must be purchased to continue with further revisions.
5. Intellectual Property
- WPDriven Property: All content, designs, and intellectual property on our Website are the property of WPDriven and are protected by law. You may not reproduce this content without our written consent.
- Client Property: All intellectual property created by WPDriven for the Client as part of a paid project will be owned by the Client upon final payment.
6. Limitation of Liability WPDriven is not liable for any direct, indirect, incidental, or consequential damages arising from your use of our Website or services. This includes, but is not limited to, loss of data, profits, or business interruption.
7. Indemnification You agree to protect and defend WPDriven from any claims, damages, or liabilities that arise from your use of our services or a breach of these Terms of Service.
8. Governing Law and Jurisdiction These Terms of Service shall be governed by the laws of the State of California, and any disputes shall be resolved in the courts of San Diego County.
