Terms of Service

1. Agreement to Terms

By accessing or using WPDriven's services, website, and products, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access our services.

2. Our Services

WPDriven provides fixed-price web design, AI automation, and CRM development services including but not limited to:

  • Websites: Landing Pages, Business Websites (5-page), Shopify E-commerce Stores
  • AI & Automation: AI Chatbots, AI Content & Social Media Automation, GoHighLevel Setup & Management
  • CRM Systems: Agent OS (Real Estate CRM), GHL Concierge, GHL Rescue for Real Estate
  • App Development: Mobile App MVP Development
  • Maintenance: Website Maintenance & Support Plans

3. Payment Terms

Deposit: A 50% deposit is required to begin any project. The remaining 50% is due upon completion before final delivery.

Payment Methods: We accept major credit cards, PayPal, and bank transfers.

Late Payments: Projects may be paused if payments are not received within 14 days of the due date.

4. Project Activation Fee for Dormant Projects

Dormant Project Definition: A project is considered dormant if it remains inactive for more than 90 consecutive days. Inactivity is defined as a lack of communication from the client, failure to provide required content or feedback, or a mutual agreement to pause work.

Reactivation Fee: If a project has been dormant for more than 90 days, a Project Activation Fee of 25% of the total project cost will be required to resume work. This fee covers the cost of re-onboarding the project, updating any outdated components, re-familiarizing our team with the project scope, and re-prioritizing it within our production schedule.

Example: For a project with a total cost of $2,000 that has been inactive for 95 days, a reactivation fee of $500 (25%) would be required before work resumes.

Fee Application: The Project Activation Fee is in addition to the original project cost and does not replace or reduce the remaining balance due. It is a separate fee for the administrative and operational work required to restart a dormant project.

Avoiding the Fee: To avoid the Project Activation Fee, clients should maintain regular communication and provide requested materials within the agreed-upon timelines. If you anticipate a delay, please notify us in writing. Brief extensions may be granted at our discretion.

Exception: If the project delay is caused by WPDriven (e.g., we miss a delivery deadline), the Project Activation Fee will not apply.

5. Delivery Timeline

Delivery timelines begin once we receive all required content (text, images, logos) from you. Standard delivery times:

  • Landing Pages: 3 business days
  • Business Websites: 5 business days
  • Shopify Stores: 5-7 business days
  • AI Chatbots: 5 business days
  • Mobile App MVP: 10 business days
  • CRM Setup (GHL/Agent OS): 10-14 business days

Client Delays: If a project exceeds the standard delivery timeline due to client delays (late content, unresponsiveness, excessive revision cycles), the project remains active. The 90-day dormancy period begins from the last date of client communication or content submission.

6. Revisions and Changes

We offer unlimited revisions during the development process. Once the project is completed and delivered, additional changes will be billed at $24.99/hour or based on a new fixed-price quote. Revision requests that alter the original project scope may require a revised quote.

7. Refund Policy

We offer a 30-day money-back guarantee on all services. If you're not satisfied with our work, we will refund your deposit in full. Refund requests must be made within 30 days of the deposit date. The Project Activation Fee (Section 4) is non-refundable once work has resumed, as it covers administrative and operational costs already incurred.

8. Client Responsibilities

You agree to:

  • Provide accurate and complete information needed for the project
  • Respond to our requests and feedback in a timely manner (within 5 business days unless otherwise agreed)
  • Own or have permission to use any content, images, or materials you provide
  • Not use our services for illegal purposes
  • Notify us in writing if you anticipate an extended delay in the project

9. Intellectual Property

Ownership: Upon full payment, you own the final website or application we create for you. We retain the right to showcase the project in our portfolio unless otherwise agreed in writing.

Third-Party Assets: Any third-party plugins, themes, or libraries used remain the property of their respective owners and may require separate licenses.

Pre-Delivery Rights: Until full payment is received, all work produced by WPDriven remains our intellectual property and may not be used, copied, or transferred.

10. Support and Maintenance

All projects include 1 month of free support after delivery. After that, ongoing support is available through our maintenance plans (from $49/month) or at $24.99/hour for ad-hoc requests. Support does not cover issues caused by third-party modifications, unauthorized access, or changes made by the client after delivery.

11. Limitation of Liability

WPDriven shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill. Our total liability shall not exceed the amount paid for the specific service in question.

12. Disclaimer of Warranties

Our services are provided "as is" without warranties of any kind, either express or implied. We do not guarantee that our services will be uninterrupted, error-free, or completely secure. We are not responsible for third-party platform changes (e.g., GoHighLevel, Shopify, WordPress) that may affect delivered work after project completion.

13. Termination

Either party may terminate a project agreement at any time with written notice. If you terminate, you will be billed for work completed up to the termination date. Any deposit paid is non-refundable upon termination, but will be applied toward the final invoice for completed work. We may terminate services immediately for violation of these terms.

14. Changes to Terms

We reserve the right to modify these terms at any time. Changes become effective immediately upon posting. Your continued use of our services constitutes acceptance of the modified terms. For active projects, the terms in effect at the time of project initiation will apply unless mutually agreed otherwise.

15. Governing Law

These terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in San Diego, California.
